1. Acceptance of Terms

By accessing and using Sustainability For You (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Sustainability For You provides a cloud-based sustainability reporting platform for companies to manage:

• Double materiality assessments
• CSRD/ESRS data collection and workflows
• GHG emissions calculations
• Evidence management and audit trails
• Team collaboration and governance
• Report generation and export

3. Account Registration

To use the Platform, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Be at least 18 years old
• Have authority to bind your company to these Terms

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to the Platform
• Interfere with other users' access to the Platform
• Use the Platform for competitive analysis or reverse engineering
• Share your account credentials with unauthorized parties
• Misrepresent your identity or affiliation

5. Data Ownership and License

Your Data

You retain all ownership rights to the data you enter into the Platform ("Customer Data"). We do not claim ownership of your sustainability reporting data.

License to Us

You grant us a limited license to use, store, and process your Customer Data solely to:

• Provide the Platform services
• Comply with legal obligations
• Improve the Platform (using anonymized, aggregated data)

6. Fees and Payment

Subscription fees are based on your selected plan (Launch, Scale, or Enterprise).

• Fees are billed monthly or annually as specified in your plan
• Prices are in Euros (EUR) unless otherwise stated
• Late payments may result in service suspension
• Refunds are provided at our sole discretion
• We may change pricing with 30 days' notice

7. Intellectual Property

The Platform, including its design, features, source code, and documentation, is owned by Sustainability For You and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Platform during your subscription.

8. Data Security and Privacy

We implement industry-standard security measures to protect your data. However:

• No system is 100% secure
• You are responsible for maintaining your account security
• You must comply with applicable data protection laws (GDPR, etc.)

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance (with advance notice when possible)
• Experience unplanned downtime
• Modify or discontinue features

We are not liable for any damages resulting from service interruptions.

10. Termination

By You

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees
• Engage in fraudulent or illegal activity

Effect of Termination

Upon termination:

• Your access to the Platform will cease
• We will retain your data for 30 days for retrieval
• After 30 days, data may be permanently deleted (subject to legal retention requirements)

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees that the Platform will meet your specific requirements
• Guarantees of error-free or uninterrupted service
• Responsibility for accuracy of your reporting data

The Platform is a tool to assist with sustainability reporting. You remain responsible for the accuracy and completeness of your reports and compliance with applicable regulations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the fees you paid in the 12 months prior to the claim

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your Customer Data

14. Governing Law and Disputes

These Terms are governed by the laws of Germany. Any disputes shall be resolved through:

• Good faith negotiation
• Mediation (if negotiation fails)
• Arbitration or courts in Germany (as a last resort)

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via:

• Email notification
• In-app notification
• Posting on this page with an updated date

Continued use after changes constitutes acceptance of the updated Terms.
